1. Definitions

"UberWorld" is the interactive on-line service provided by a number of volunteers on the internet, consisting of a multi-user realtime chat program and webpages. "Subscriber" means each person who establishes or accesses a "Connection" for access to and use UberWorld (via telnet or the world wide web) and its services. "The administrators of the UberWorld talker" are defined as Gavin Brown and Jeremy Modjeska. Additional definitions related to our Privacy Policy are enumerated in Section 8 below.

2. General

UberWorld and this web site are provided to you free of charge, "as is", by the administrators of the UberWorld talker. By using the information and services provided you are agreeing to the terms and conditions contained herein. UberWorld and this web site contain links to other sites that may contain additional terms of use. Your use of any external sites shall also subject you to the terms of use of each of those sites.

3. Liability Disclaimer

The services and links available to you on UberWorld and this website may contain errors and are subject to failure and interruption. While the administrators do their best to maintain the information and services they offer, they cannot be held responsible for any errors, defects, lost profits, or other consequential damages arising from the use of UberWorld or this website. You should therefore not assume that UberWorld or this website are error-free.

THE UBERWORLD ADMIN PROVIDE THE INFORMATION AND SERVICES AVAILABLE ON UBERWORLD AND THIS WEB SITE "AS IS," WITH NO WARRANTIES WHATSOEVER. 5. Indemnification

Subscriber agrees to defend, indemnify and hold harmless the administrators of UberWorld, its affiliates, agents, contractors and directors from and against all claims and expenses, including attorneys' fees, arising out of the use of UberWorld by Subscriber or Subscriber's Connection.

6. External Links

Any and all sites linked to on the UberWorld website have not been reviewed by the UberWorld admin and, as such, the UberWorld admin are not responsible for and make no endorsement, express or implied, of such sites or the content, software or services thereof.

7. Proprietary Information

No part of UberWorld or this website may be reproduced in any way, or by any means without prior written permission of the UberWorld administrators.

8. Privacy Policy

This Privacy Policy describes UberWorld's policies and procedures relating to the collection, use, and disclosure of your information when you use UberWorld; and it tells you about your privacy rights and how the law protects you.

8.1 Interpretation and Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account that you created to access UberWorld.
  • "We", "Us", "the Service", or "Our" refers to UberWorld.
  • Country refers to United States, where UberWorld is hosted.
  • Device means any device that can access the Service, which is likely a computer, but could include cellphones or tablets if you're sufficiently creative.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of an UberWorld session).

8.2 Personal Data

While using UberWorld, we may ask you to provide us with certain personally identifiable information. Personally identifiable information may include, but is not limited to:

  • Email address (required to create an account)
  • First name and last name (optional)
  • Phone number (optional)

We use your personal data to provide and maintain the UberWorld service, which includes the monitoring of UberWorld's usage and performance. Specifically, we use your data as follows:

  • To manage your registration and account as a user of the Service. The Personal Data you provide can give you access to different functionalities of UberWorld that are available to you as a registered user.
  • To contact you by email, for example in the event of a system-generated message or password reset.
  • To provide you with news, service updates, and general information. We do not use your email for any marketing purposes, nor do we sell or otherwise make it available to third-parties for marketing purposes. We might, on rare occasions, share important updates about UberWorld with you via your email address.
  • To track and respond to any inquiries or issues that you submit to the UberWorld administrators and staff via email or via the UberWorld service.

UberWorld may share your personal information in the following situations:

  • When you share personal information or otherwise transmit data to UberWorld (including when you create/update your user profile), some information may be viewed by all users and/or may be publicly distributed. You should not put anything sensitive, private, or otherwise not intended for public disclosure in your examine (x) profile, whois file, or any other file, message, post, or other communication on UberWorld, including one-to-one messages and public/private channels, because telnet is not a secure communication medium.
  • In the event of suspected harassment or other violation of UberWorld's Rules (see help rules), a user may initiate logging of incoming private messages, which will become available to UberWorld staff and administrators indefinitely.

UberWorld will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to maintain reasonable backups for the ongoing availability, reliability, and disaster recovery capabilities of the UberWorld service, to comply with legal obligations, to resolve disputes, and to enforce our legal agreements and policies.

8.3 Usage Data

Usage Data is collected automatically when you connect to UberWorld. Usage Data may include information such as your Device's IP address, the time and date of your visit, command history and logs, telnet client information, time spent on UberWorld, and other potentially-unique information and diagnostic data.

UberWorld retains Usage Data for internal analysis purposes and to keep various user- and staff-/admin-facing features up-to-date and accurate. For example, spodlist depends on aggregate per-user connection time.

8.4 Transfer of Your Data

Personal Data and Usage Data are processed on the servers where UberWorld operates, which includes assets maintained by cloud service and other providers (such as Amazon Web Services). This means your data may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where data protection laws may differ from those in your jurisdiction.

8.5 Disclosure of your Personal Data

In the unlikely event that UberWorld is involved in any kind of business transaction, such as a merger, acquisition, or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

8.6 Law enforcement

Under certain circumstances, UberWorld may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).

8.7 Other legal requirements

UberWorld may disclose your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend Our rights or property
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the Service or the public
  • Protect against legal liability

8.8 Security of Your Personal Data

UberWorld uses telnet for all user connections and communications. Telnet is a very old and inherently insecure technology.

Do not use telnet if you care about security or privacy.

We're only here because people still like using talkers, and we assume that anyone who likes using talkers understands that they aren't using a secure service. UberWorld cannot secure any data that you transmit or receive when using the UberWorld service. Do not transmit or receive anything sensitive or private. If you are looking for a secure communication platform, please look elsewhere!

8.9 Children's Privacy

UberWorld is available to users 18 years of age or older. We expressly forbid anyone under the age of 18 to create, use, or otherwise access an UberWorld account. We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 18 without verification of parental consent, We will take steps to remove that information from Our servers.

8.10 Changes to this Privacy Policy

We may update Our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
